Can patents be transferred to someone else?

When someone holds a patent on a certain product or design, they are the only one who is allowed to use it. Their intellectual property has been protected. Another company can’t begin manufacturing and selling the same product, for example, as it would be a patent violation.

But what if that person wants to transfer the patent to someone else? Could an individual transfer their patent to a business or another person? Could one business transfer a patent to another company?

Many transfers are possible

Yes, the United States Patent Office notes that patents qualify as personal property. As such, it is possible to sell them to another party, and many patents are considered valuable assets that businesses own. In some cases, a business will directly buy a patent from another company rather than trying to develop its own product. They see it as a wise investment because they’ll make their money back selling those products after they have the necessary intellectual property.

Sales are not the only transfers that can happen. In some cases, a patent will be mortgaged or even leased for a specific amount of time. In other cases, a person could put a patent into their will, which means that it transfers down to a specific beneficiary after they pass away.
